THE HIGHEST OFFICIAL IN THE CONSTITUENT ENTITY OF THE RUSSIAN FEDERATION: LEGAL STATUS ISSUES

Abstract
Background. The constantly changing legislation on the system of authorities in the constituent entities of the Russian Federation actualizes not only the analysis of the elements of this system, but also the choice of research methods. The article discusses the legal status of the highest official in the constituent entity of the Russian Federation. The terminological construct “legal status” chosen for study allows focusing on the most essential legal characteristics of the highest official in the constituent entity of the Russian Federation. Materials and methods. The set tasks are achieved through the analysis of theoretical structures and regulatory legal acts and the practice of implementing federal regulations in the constituent entities of the Russian Federation. The methods used are based on the tools of the general theory of state and law, as well as constitutional law. General scientific methods are used in the study, as well as special methods of legal science: formal legal analysis, comparative approach, etc. Results. The main approaches to understanding the structure of the legal status of the highest official in the constituent entity of the Russian Federation are presented, the elements of the legal status are substantiated, and the grounds for such a distinction are stated. Conclusions. The content of the legal status of the highest official in the constituent entity of the Russian Federation is determined by federal legislation and has time limits. The beginning of implementing the norms fixing the legal status is the day of taking the oath by the highest official and ends with the termination of powers of the official. Beyond this period, the person does not have the appropriate powers, and therefore has no legal status. Other norms combined into the concept of the highest official (procedure for election to an office, rights of a person who has ceased to perform duties) cannot be included in the concept of “legal status”.
